    For international orders AndrewsHeadShop.com does not guarantee that customs will not confiscate the products ordered by you. US Code 21-863 refers to ALL materials used to manufacture tobacco accessories; metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes. In specific, pipes with carburetion devices (third holes) are considered to be paraphernalia regardless of the material used to manufacture the pipe. Traditional tobacco accessories like pipes, cigar and cigarette holders and hookah/sisha pipes are not included in the list of Contemporary accessories. U.S. vs. Posters & Things (Supreme Court - 1996) upholds this code as the OBJECTIVE standard by which paraphernalia is judged. Further, it describes other relevant factors in this determination to include whether the owner is a licensed distributor or retailer of tobacco products. Ten states have adopted USC 21-863 as state law, three more are in the process of adoption. All other states have either less rigorous SUBJECTIVE (intent) statutes or no law on this  all! 7. TYPOGRAPHICAL ERRORS

    In the event that a product is mistakenly listed on our website at an incorrect price, We reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Andrew’s Head Shop reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall issue a credit to your credit card account in the amount of the incorrect price.

8. ACCURACY OF BILLING AND ACCOUNT INFORMATION

    We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF GOBBLIN’ SALES INC. AND ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS TO ANY PARTY (REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE GREATER AMOUNT OF $100 OR THE AMOUNT YOU HAVE PAID TO GOBBLIN’ SALES INC. FOR THE APPLICABLE CONTENT OR SERVICE OUT OF WHICH LIABLITY AROSE.

13. INDEMNITY

    You will indemnify and hold GOBBLIN’ SALES INC., its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the “Indemnified Parties”) harmless from any breach of these Terms of Use by you. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized uses, and you agree to identify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys’ fees of the Indemnified Parties in connection therewith. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of the information accessed from this site.

The Company reserves the right to fully cooperate with any law enforcement authorities or court order requesting or directing the Company to disclose the identity of anyone posting any email messages, or publishing or otherwise making available any materials that are believed to violate these Terms of Use. BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS GOBBLIN’  SALES INC  FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY GOBBLIN SALES INC. DURING OR AS THE RESULT OF ITS INVESTIGATIONS BY EITHER GOBLIN’ SALES INC.  OR LAW ENFORCEMENT AGENCIES.  

15. TERMINATION OF USE

    You agree that we may, at our sole discretion, terminate and suspend your access to all or part of the Site with or without notice and for any reason, including, without limitations, breach of these Terms. Any suspected fraudulent, abusive or illegal activity may be grounds for barring your access to this Site, and reporting you to the proper authorities, if necessary.

16. MISCELLANEOUS

    These terms of use will be governed and interpreted pursuant to the laws of New York, United States of America, notwithstanding any principles of conflicts of law & without regard to choice of law provisions; not by the 1980 U.N. Convention on contracts for the international sale of goods. You specifically consent to personal jurisdiction in New York in connection with any dispute between you and the Company arising out of these Terms of Use or pertaining to the subject matter of hereof. The parties of these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use or pertaining to the subject matter of these Terms of Use will be in the state and federal courts in New York, New York. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of the company’s products) must be commenced within one (1) year after the claim or cause of action arises. The company's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right.
